Terms of Service

Preamble
These Terms of Service (the "Terms") govern the relationship between the User and the UnderVPN Service (the "Service") with respect to providing the User with access to the functionality of the Service.
Starting to use the Service (registration, payment for a Subscription, sign-in) means full and unconditional acceptance of these Terms.
Information about the processing of User data is available in the Privacy Statement.
1. Definitions

2. Description of the Service
2.1. Purpose
The UnderVPN Service provides the User with access to a cloud infrastructure that allows establishing a secure network connection through the Service's servers located in various geographic regions.
The Service aims to provide:
- Application of encryption to the User's network traffic within the protocols supported by the Service
- Routing of traffic through the Service's servers
- The ability to access internet resources through the server selected by the User
- Application of technical measures intended to protect the privacy of the User's network activity
These functions are implemented within the limits of the technical solutions used by the Service and do not constitute an absolute guarantee of any particular result.
2.2. What the Service is NOT
- The Service is not a telecommunications operator
- The Service is not a hosting provider
- The Service does not provide any warranties as to the content of third-party internet resources accessed through the Service
2.3. Conditions of provision
The Service is provided "as-is". The Service makes reasonable efforts to ensure operability but does not guarantee:
- 100% uptime
- The availability of all servers at any given moment
- Guaranteed connection speeds
- Access to any particular third-party resources
2.4. Dependence on third-party infrastructure
The operation of the Service depends on the use of infrastructure and services of third parties over whose work the Service has no direct control. Such third parties include, in particular:
- The Telegram platform (Telegram Messenger Inc.) — provides the operation of the Telegram bot
@gutvpn_botas a channel of interaction between the User and the Service. The User's use of the Telegram bot is additionally governed by Telegram's terms of service published at telegram.org/tos, as well as the Terms of Service for the Telegram bot platform published at telegram.org/tos/bots. The Service operates the Telegram bot in accordance with the applicable policies of the Telegram platform - Engaged Payment Providers — handle the acceptance and refunding of funds. The terms of service and privacy policies of each Payment Provider are published directly on their websites
- Infrastructure providers — supply the computing resources, network infrastructure and content delivery services required for the Service to operate
The Service is not responsible for:
- The User's inability to use a particular channel of interaction with the Service for reasons related to acts (or omissions) of third parties, including suspension or restriction of access to the Telegram platform, to the Service's website or to other infrastructure used, imposed by government authorities, internet providers or other parties
- Changes made by third parties to their services (changes to APIs, policies, pricing) and the related temporary limitations on the Service's functionality
- The content and terms of use of third-party services, which are governed by their own documents
If a particular channel of interaction is unavailable, the Service makes reasonable efforts to provide the User with access to the Service through other available channels contemplated by these Terms.
3. Registration and account
3.1. Methods of registration
Registration is carried out through one of the following channels:
- Telegram bot
@gutvpn_bot— identification by Telegram ID - Website
my.undervpn.org— via an email address with confirmation, or via third-party authentication providers (the current list is shown to the User on the sign-in page)
The set of available registration channels and the list of supported OAuth providers may change. The current list of available methods is shown to the User on the corresponding registration and sign-in pages.
3.1.1. Additional sign-in methods after registration
After completing registration the User may configure additional sign-in methods in the Dashboard, including:
- Passkey / Face ID — sign-in using cryptographic credentials bound to the User's device, in accordance with the WebAuthn standard
These methods are sign-in methods for an already created account and do not create a separate account.
3.2. Multiple accounts and linking
A single natural person may hold several accounts in the Service, created through different registration channels (for example, via the Telegram bot and independently via the website). Each account is independent — Subscriptions, payments and other parameters are not transferred between unlinked accounts.
A User who holds several accounts may link them together via the "Account linking" section in the Dashboard of an existing account. After linking, the accounts become a combined account with a shared balance, shared Subscriptions and shared settings.
Acts of the User performed within a linked account (including violations of the AUP) affect all linked accounts of the User.
3.3. Age restrictions
The Service is intended for use by persons over the age of 18. By registering, the User confirms that they meet this requirement.
If a parent or legal guardian becomes aware of the use of the Service by a minor, deletion of the account may be requested by sending the corresponding request to the email address support@undervpn.org with the subject line "Deletion of a minor's account" and attaching documents confirming parental or guardian rights.
3.4. Accuracy of data
The User agrees to provide accurate data at registration and to keep it up to date in the Dashboard.
The Service is not responsible for the consequences of the User providing inaccurate, incomplete or outdated data, including the inability to deliver notifications, receipts, responses to requests or other correspondence through the contact channels indicated by the User. All adverse consequences of such situations are borne by the User.
3.5. Account security
The User is responsible for:
- The security of access to their Telegram or email account
- All actions performed in the Service under their account
In case of compromise of access, the User agrees to contact support without delay.
4. Pricing and payment
4.1. Pricing
The current pricing and the cost of the Subscription are published at undervpn.org/#pricing and in the Dashboard.
The Service may change pricing unilaterally. New pricing applies to Subscriptions taken out after publication of the new pricing schedule. For existing recurring billing arrangements, changes to the amount of the recurring charge are governed by section 12.2 of these Terms and by the Recurring Billing Policy.
The Service is not responsible for temporary discrepancies in the display of pricing across different pages and interfaces (website, Dashboard, Telegram bot) caused by technical reasons (caching, delays in data updates). If a discrepancy is detected, the final cost of the Subscription is determined at the payment step in the Payment Provider selected by the User.
4.2. Payment methods
Payment is made via third-party Payment Providers engaged by the UnderVPN Service. The list of available payment methods and information about the engaged Payment Providers is shown to the User at the Subscription checkout step.
The UnderVPN Service may change the list of engaged Payment Providers and available payment methods without separate notice to Users.
4.3. Prepayment
All services of the Service are provided on a full prepayment basis.
4.4. Receipts
Payment receipts are generated automatically on the side of the engaged Payment Provider in accordance with applicable law and are sent to the User at the contact email address indicated by them.
The User is responsible for the accuracy of the contact email address provided at payment and for ensuring the ability to receive correspondence at it (no mailbox overflow, correctly operating spam filters, access to the indicated email). The Service is not responsible for the inability to deliver a receipt for reasons attributable to the User's side or the engaged Payment Provider's side.
4.5. Billing period
The Subscription period is calculated in calendar days from the moment the payment is received, for the duration set by the tariff selected by the User, and does not depend on the actual use of the Service by the User.
This billing model is dictated by the continuous nature of the Service's server infrastructure operation and the reservation of computing resources for each User for the entire term of the Subscription regardless of the actual volume of connections of any particular User.
The User's right to a refund of the Subscription cost in the absence of actual use is exercised in the manner provided for by the Refund Policy, including through the 30-day full refund window for the first Subscription.
4.6. Termination of a paid Subscription
Upon expiry of the paid Subscription period and in the absence of its renewal:
- The User's access to paid functions and the parameters of the selected tariff of the Service is terminated
- The User's account is retained and transferred to the free tariff plan of the Service (if such a plan exists in the current pricing schedule). The parameters of the free tariff plan, including the capabilities and limitations provided under it, are determined by the Service at its sole discretion and may change in the manner provided for in section 12 of these Terms
- The Subscription may be resumed at any time on the current conditions published in the Service at the moment a new Subscription is taken out
4.7. Legacy tariffs
Individual tariffs may be classified by the Service as legacy and marked accordingly in the Dashboard and at checkout. Legacy tariffs are available to the User only on the condition of uninterrupted payment of a Subscription on such a tariff.
If the paid Subscription period for a legacy tariff expires and is not renewed in time, the User's access to that tariff is lost irrevocably: Subscription may subsequently be resumed only on a tariff from the Service's current pricing schedule. Restoration of access to a legacy tariff after it has been lost is not performed.
The Service does not guarantee the retention of legacy tariffs in the current pricing schedule, is not obliged to reinstate them upon a User's request, and may discontinue providing them to Users who, at the time of discontinuation, do not hold an active paid Subscription on the corresponding legacy tariff.
4.8. Trial period
The Service offers the opportunity to try out the Service's functionality during a free trial period.
Trial period terms:
- The duration of the trial period, the traffic limit and the number of simultaneously connected devices are set by the Service and shown to the User at activation (as of the publication of these Terms — 5 (five) calendar days, 50 GB of traffic, 1 device)
- The trial period is activated without payment and without linking a payment method of the User
- Activation of the trial period in the Service is available to the User once only. Repeat activation after a previously used trial period — regardless of the circumstances of its completion, the actual duration of use, and the occurrence of events affecting the account — is not allowed
- The Service may change the parameters of the trial period (duration, limits, conditions of activation) at any time without separate notice to the User; the changed parameters apply to new activations carried out after they take effect
Activation:
- When the User registers via the
my.undervpn.orgwebsite, the trial period may be activated automatically based on the Service's settings in force at the time of registration - When registering via the Telegram bot, activation of the trial period is performed by the corresponding action of the User in the bot interface
End of the trial period:
- Upon expiry of the trial period — transfer of the account to the free tariff plan in the manner provided for in section 4.6 of these Terms
- Upon early payment by the User for a paid Subscription — the trial period ends, and further access is provided under the paid Subscription
- Upon violation of the AUP by the User — suspension in the manner provided for in section 4 of the AUP
Refunds and compensation:
The trial period is provided free of charge. No refunds are made for the trial period. Compensation for the trial period in the event of technical failures of the Service (section 5 of the Refund Policy) is not provided — that compensation applies only to paid Subscriptions.
Referral Program and Partner Program:
The User's activation of the trial period is not deemed the first payment for a Subscription within the meaning of the Referral Program Rules and does not result in the base bonus being credited to the Referrer or the Referral. The corresponding bonuses are credited only after the first successful payment by the User for a paid Subscription.
5. Subscription and recurring billing
A Subscription may be taken out either as a one-time payment or with automatic renewal (recurring payments).
The rules governing recurring billing, the User's consent to automatic charges, notifications before charging and cancellation of recurring billing are set out in a separate document — the Recurring Billing Policy.
6. Refunds
The terms for refunds of the Subscription cost are set out in a separate document — the Refund Policy.
Brief summary:
- Within 30 (thirty) calendar days from the date of the first payment for a Subscription — a full refund of the cost of the first Subscription
- After 30 days (including on automatic renewals of the Subscription) the service is deemed rendered by the Service for each elapsed billing period; no refunds are made due to a change in the User's intent
- In the event of technical failures on the Service's side lasting more than 24 continuous hours — compensation in the form of extending the Subscription by a period equivalent to the duration of the failure (see Refund Policy section 5)
- If an account is suspended for especially serious violations of the AUP (section 4.3) — no refund is made
- If an account is suspended for other violations of the AUP — a refund of the cost of the unused portion of the Subscription may be provided by the Service at its sole discretion
- If circumstances of force majeure last more than 30 calendar days — refund of the cost of the unused portion of the Subscription in the manner provided for in section 9.4 of these Terms
- If the Service ceases operations as a whole — refund of the cost of the unused portion of the Subscription (see section 10.3 of these Terms)
- If the User disagrees with material changes to these Terms — refund of the cost of the unused portion of the period (see section 12.2 of these Terms)
7. Rules for using the Service
The full list of prohibited types of use is set out in the AUP.
Brief summary of the principal prohibitions:
- Distribution of extremist materials, CSAM, incitements to violence
- Infringement of intellectual property rights (illegal P2P, torrents)
- Cyberattacks (DDoS, hacking, spam, phishing)
- Reselling access to third parties
In case of an AUP violation, the Service may immediately suspend the account without a refund.
8. Rights and obligations of the parties
8.1. The User has the right to
- Receive access to the functionality of the Service within the limits of a paid Subscription
- Request support through the communication channels provided
- Request a refund in accordance with the Refund Policy
- Stop using the Service at any time
- Delete their account via the Dashboard or by request to support
8.2. The User agrees to
- Use the Service only within the law of the User's jurisdiction
- Comply with the AUP
- Not transfer access to the account to third parties
- Pay for the Subscription on time (when using recurring billing — keep a valid payment method)
8.3. The Service has the right to
- Change functionality, pricing, server geography
- Suspend operation for maintenance (with notice, where possible)
- Suspend accounts for violations of the AUP
- Cease providing services to a particular User where there are grounds
8.4. The Service agrees to
- Make reasonable efforts to ensure operability of the Service
- Apply reasonable measures to protect User data in accordance with the principles set out in the Privacy Statement
- Process User refund requests in the manner provided for in the Refund Policy
- Comply with these Terms to the extent not inconsistent with applicable law and force majeure circumstances (section 9.4)
The Service's obligations are obligations of reasonable efforts rather than guaranteed results, and are performed within the technical, organisational and financial capabilities of the Service.
9. Limitation of liability
9.1. The Service is not responsible for
- The acts and omissions of the User when using the Service, or the consequences of such acts (or omissions) for the User themselves and for third parties
- The content of third-party internet resources accessed through the Service
- Technical failures caused by the acts of third parties (DDoS attacks, acts of infrastructure providers, acts of Payment Providers, acts of the Telegram platform)
- Suspension of access by government authorities, telecommunications operators or internet providers
- Inoperability of the Service due to circumstances beyond the reasonable control of the Service (section 9.4 — Force Majeure)
- Indirect losses, lost profits, moral damage, reputational harm
- Loss or damage to the User's data arising for reasons not attributable to the Service, including as a result of the acts of third-party software, the operating system of the User's device or the internet provider
- Incompatibility of the Service with particular software or hardware of the User
- The consequences of the User using outdated versions of client applications used to connect to the Service
- The inability to access individual internet resources through the Service, including for the reason that such resources apply technical measures to detect and block connections going through the Service's infrastructure
- The acts and omissions of other Users of the Service
- Any consequences of the User using the Service in violation of these Terms or the AUP
9.2. Amount of liability
In any event, if liability of the Service is established, it is limited to the amount actually paid by the User for the Subscription for the period in which the incident occurred.
9.3. Security
The User uses the Service at their own risk. The Service does not guarantee:
- 100% anonymity
- 100% protection against deanonymisation
- Protection against criminal, administrative, civil or other proceedings for acts committed using the Service
- Full conformity of the Service with the requirements of any particular jurisdictions
- The impossibility of third parties identifying the fact that the User uses the Service
- The Service remaining operational under mass deployment by third parties of deep packet inspection systems
- The availability of individual functions of the Service on devices with outdated operating systems or client applications
9.4. Force majeure
A party is not liable for non-performance or improper performance of its obligations under these Terms if such non-performance was the result of force majeure circumstances — extraordinary and unavoidable circumstances under the given conditions which the party could not have foreseen and prevented by reasonable measures.
Such circumstances include, in particular:
- natural disasters (earthquakes, floods, fires and other natural catastrophes)
- military action, armed conflict, civil unrest, acts of terrorism
- epidemics, pandemics and other circumstances connected with large-scale restrictions
- acts of state and municipal authorities that materially restrict the Service's ability to provide the service
- acts (or omissions) of third parties (infrastructure providers and parties connected to infrastructure) that materially restrict the Service's ability to provide the service
- other circumstances recognised as force majeure under applicable law
In the event of force majeure circumstances, the Service notifies Users through the available communication channels provided for in section 12.2 of these Terms within a reasonable period from the moment when it became possible to establish the occurrence of such circumstances.
During the period of force majeure circumstances, performance of the parties' obligations is suspended without applying liability measures to the party that is unable to perform the obligation.
If force majeure circumstances last more than 30 (thirty) calendar days, the User may stop using the Service with a refund of the cost of the unused portion of the Subscription in the manner provided for in the Refund Policy.
9.5. Indemnification by the User
The User agrees to compensate the Service for documented losses incurred by the Service as a result of:
- The User's violation of these Terms, the AUP or other related documents of the Service
- The User's use of the Service in violation of applicable law
- Claims, suits or demands brought against the Service by third parties (including government authorities, other users of third-party services, rights holders) arising in connection with the User's acts (or omissions) when using the Service
Reimbursable losses include, in particular: amounts of fines imposed on the Service by competent authorities; amounts paid by the Service to third parties to satisfy their well-founded claims; the Service's costs of obtaining legal assistance in connection with such claims; the Service's costs of restoring the operability of the infrastructure in connection with the User's acts.
This obligation of the User survives the cessation of use of the Service and the deletion of the account (see section 15.5).
9.6. Disclaimer of implied warranties
To the extent permitted by applicable law, the Service is provided without any implied warranties, including, in particular:
- Warranties of fitness of the Service for the User's particular purposes
- Warranties of the Service conforming to the User's expectations
- Warranties of uninterrupted, error-free or secure operation of the Service
- Warranties that the results of using the Service will meet the User's requests
- Warranties of correction of all defects or non-conformities of the Service
The User independently assesses the fitness of the Service for their purposes and bears all risks associated with the use of the Service.
10. Termination of use
10.1. At the User's initiative
The User may stop using the Service at any time:
- By cancelling recurring billing — the Subscription remains in effect until the end of the paid period. No refund of the cost of an already paid period is made on cancellation of recurring billing (see Recurring Billing Policy section 6.2)
- By deleting the account — access to the Service is terminated immediately. A refund of funds for the remaining term of the Subscription is made only in the cases and in the manner provided for in the Refund Policy. Deletion of the account by the User on their own initiative after the expiry of the 30-day refund window does not, as a general rule, give rise to a right to a refund
10.2. At the Service's initiative
The Service may cease providing services to a particular User:
- For a violation of the AUP — in the manner provided for in section 4 of the AUP. On suspension for a violation of the AUP that is not classified as especially serious (section 4.3 of the AUP), a refund of the cost of the unused portion of the period may be provided by the Service at its sole discretion in accordance with section 1 of the Refund Policy. On suspension for especially serious violations (AUP section 4.3), no refund is made
- On failure of recurring billing — after unsuccessful charge attempts in the manner provided for in section 5 of the Recurring Billing Policy. No refund of the cost of an already paid but expired period is made in this case
- On cessation of operations of the Service as a whole — with a refund of the cost of the unused portion of the Subscription (see section 10.3 of these Terms)
10.3. Cessation of operations of the Service
If the Service decides to cease operations:
- Users are notified at least 30 calendar days in advance
- A refund is made for the unused paid period
11. Confidentiality
The processing of User data is described in a separate document — the Privacy Statement.
Information about the use of cookies on the website is described in the Cookie Notice.
12. Changes to the Terms
The Service may change these Terms. The procedure for making changes depends on the nature of the amendments.
12.1. Technical edits
Edits that do not affect the rights and obligations of the User (correction of typos, clarification of wording, updates to links, refreshing contact information, payment details and the list of engaged Payment Providers) may be made without separate notice. The current version of the Terms is published on the Terms page.
12.2. Material changes
Changes that worsen the User's position (increase in the amount of payment under existing tariffs, reduction in the scope of functionality, change in the rights and obligations of the parties) take effect no earlier than 30 (thirty) calendar days from the moment of notification to the User.
Notice of material changes is sent through one or more of the Service's communication channels, including: the Telegram bot @gutvpn_bot, the Service's Telegram news channel, the "News" section on the undervpn.org website, and the User's email address (if one is on the account). The notice contains a link to the new version of the Terms.
If the User disagrees with the changes, the User may:
- Stop using the Service before the changes take effect
- In relation to an existing paid Subscription — request a refund of the cost of the unused portion of the period in the manner provided for in the Refund Policy
12.3. Changes due to legal requirements
Changes made in order to bring these Terms into conformity with regulatory acts that have entered into force or are about to enter into force take effect on a date that ensures compliance with such requirements. The User is notified of such changes within a reasonable period before they take effect, or immediately upon their introduction, unless otherwise provided by applicable law.
12.4. Consent to changes
Continued use of the Service after a new version of the Terms takes effect means the User's consent to the changes.
13. Dispute resolution
13.1. Pre-action procedure
In the event of a dispute, the User sends a claim to the Service at the email address support@undervpn.org.
The Service reviews the claim within 30 calendar days from the date of receipt.
13.2. Further resolution
Where pre-action resolution is not possible, disputes are resolved in the manner provided for by applicable law.

Management of the Subscription and account is performed via the Dashboard, the composition of which is described in section 1 of these Terms.
15. Final provisions
15.1. Relationship with other documents
These Terms are inseparably linked to and apply jointly with:
15.2. Hierarchy of documents
In case of conflict between documents:
- Recurring Billing Policy — takes precedence on matters of automatic charges
- AUP — takes precedence on matters of prohibited use
- Refund Policy — takes precedence on matters of refunds
- Privacy Statement — takes precedence on matters of data processing
- These Terms — general provisions
15.3. Invalidity of individual provisions
If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.
15.4. Entire agreement
These Terms together with the related documents constitute the entire agreement between the User and the Service and supersede all prior arrangements.
15.5. Surviving provisions
Termination of these Terms — at the initiative of either party, on expiry of the Subscription, in connection with the User's deletion of the account or on any other grounds — does not release the parties from performing obligations that arose before the termination of the Terms, and does not terminate those provisions which by their nature must survive termination, including:
- The limitation of liability provisions (section 9)
- The provisions on the processing of the User's data in accordance with the Privacy Statement
- The provisions on retention of information for the periods established by applicable law (see Privacy Statement section 7)
- The provisions on the procedure for dispute resolution and applicable law (section 13)
- The obligations of the User connected with previously committed acts when using the Service, including obligations arising from violations of the AUP
15.6. Assignment of rights and obligations
The User may not assign their rights and obligations under these Terms to third parties without the prior written consent of the Service. The transfer of access to the User's account to third parties is governed by section 2.6 of the AUP.
The Service may assign its rights and obligations under these Terms by way of universal succession (reorganisation of the legal entity operating the Service), as well as on transfer of the operation of the Service to another party with notice to Users in the manner provided for in section 12.2 of these Terms.
